Terms of Service

1. Acceptance of Terms

By creating an account or using Motusphere, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

2. Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it. You must be at least 18 years old to use Motusphere. You agree to provide accurate information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable Use

You agree not to:

• Post illegal, defamatory, threatening, or harassing content.
• Upload malware, spam, or fraudulent listings.
• Scrape, crawl, or access the platform via automated means without permission.
• Impersonate other users or misrepresent your identity.
• Circumvent any access controls, rate limits, or security measures.
• Use the platform to promote dangerous or reckless riding behaviour.

Violations may result in content removal, account suspension, or permanent termination at our discretion.

4. User-Generated Content

You retain ownership of all content you post on Motusphere, including routes, photos, posts, and listings. By posting content, you grant Motusphere a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote that content within the platform and for marketing purposes. You may delete your content at any time, which will revoke this licence (except for cached or archived copies that may persist briefly).

5. Subscriptions and Payments

Motusphere offers free and paid subscription plans. Paid plans are billed monthly or annually through Stripe. You may cancel your subscription at any time from your Settings page. Cancellation takes effect at the end of the current billing period -- no partial refunds are provided. We reserve the right to change pricing with 30 days notice.

6. Marketplace

The Motusphere Marketplace facilitates connections between buyers and sellers. Motusphere is not a party to any transaction and does not guarantee the quality, safety, legality, or accuracy of any listing. You are solely responsible for verifying listings, arranging payment, and completing transactions safely. Motusphere is not liable for any disputes, losses, or damages arising from marketplace transactions.

7. Routes and Ride Data

Routes and ride data shared on Motusphere are user-generated and provided for informational purposes only. Road conditions, legality, and safety may change. Always ride responsibly and verify conditions before following any route. Motusphere is not responsible for any incidents that occur while riding.

8. Account Termination

You may delete your account at any time from your Settings page. We may suspend or terminate your account if you violate these terms, engage in abusive behaviour, or if required by law. Upon termination, your personal data will be deleted in accordance with our Privacy Policy.

9. Limitation of Liability

Motusphere is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Motusphere and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the platform.

10. Governing Law

These terms are governed by the laws of the Province of Alberta, Canada. Any disputes arising from these terms or your use of Motusphere shall be resolved in the courts of Alberta.

11. Changes to Terms

We may update these terms from time to time. If we make significant changes, we will notify you via email or an in-app notice. Continued use of Motusphere after changes constitutes acceptance of the new terms.
